Dear Sir/Madam,

Hope you are doing well.

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form for the year 2022. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not able to provide me with my BIR 2316 form.

It would be very much appreciated if you can send me a copy via email as my employment is on the line — I have to submit this on October 15.

Dear Mr. Hontiveros:

I refer to my letter of Oct 06, 2023 04:35:47 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for BIR 2316 for the year 2022.

In reply, BIR Form No. 2316 is a form issued by your employer (A Certificate). Hence, you may request for the issuance of the said documents to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.

And bakit po kaya hindi kayo nabigyan ng inyong employer ng copy ng BIR Form No. 2316 para sa Taong 2022?

With the employer's obligation to give you the original copy of the form, it is therefore your right to request said copy from your employer. 

While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your employer is registered would take longer to provide you the information you have requested. They have to verify if your employer has submitted to them the List of Employees Qualified under substituted Filing of Income Tax Return (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jan 01, 2024 04:49:51 AM, your request will be closed.
