I refer to my letter of Jan 17, 2022 08:00:55 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for my Income Tax Return.

In order for us to work further on your request, kindly provide us the following details and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information:
What ITR form did you file from 2004-2008? 
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file.

However, if you know where you filed your ITRs, you may directly request it to the concerned RDO as they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 11, 2022 10:48:54 AM, your request will be closed.

Based on the information gathered as of this writing, it was noted that when you requested for the ITR (2316) you are referring to the BIR Form 2316.  It is necessary to identify this as we initially interpreted that you are requesting for Income Tax Returns with attached 2316.  We tried to look for your filed income tax returns for the years 2004 to 2008 but there were no records in our file database.  After you submitted the additional information, we then understood that you are referring to the BIR Form 2316.


To clarify, BIR Form 2316 is often confused as the Income Tax Return for individuals. However, these two are not necessarily the same.  Income Tax Returns for individual taxpayers are filed by the taxpayer him/herself at the BIR office where he/she is registered, while the BIR Form 2316 is filed by the Employer, for an employee qualified for substituted filing, at the BIR Office where the employer is registered.  In your case, the BIR Form 2316 for the years 2004-2008 were presumably filed by your employer based on the information provided.


                In view of this, we would like to get additional information in order for us to process your request.  Kindy provide the following details:


o   Employer Name: NCAS

§  The complete name of your employer (NCAS) and the Tax Identification Number of your employer (NCAS) if the same is available to you.  We need this information as there were a number of companies with similar acronym to NCAS and we need the complete name to avoid giving you the wrong information.

§  Any proof that you were previously employed by NCAS for privacy reasons (ex: A copy of your Company ID, any other proof available to you)
