Good day!

My previous employer did not provide me any copy of BIR Form 2316 since I started working for them or even after my clearance process is already done as I have resigned from my work. My new employer is requiring me to provide them with this document, but my previous employer is not responding with my concern/request regarding this matter. 

I would like to ask if there are other ways to acquire this document aside from asking it from my previous employer?

Dear Ms. Zulueta:

I refer to my letter of Aug 16, 2023 04:15:55 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR FORM No. 2316.

In reply, the Revenue District Office (RDO) can only provide you a copy of your BIR Form No. 2316 for Calendar Year 2022 if your employer has filed in your behalf. They will also be requiring you to present a copy of the duly received Annex F which can be obtained from your employer in which your name is included in the List of Employees Qualified Under Substituted Filing.

For BIR Form No. 2316 for CY 2023, the RDO gets a hold of the said form upon submission of your employer to them on or before February 28, 2024.

For other concern, email sherry.ann.arcita@bir.gov.ph and indicate in the email subject ticket number #BIR-377787519691, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 09, 2023 03:40:25 AM, your request will be closed.
