Dear Ms. Figueroa,

I refer to my letter of Jan 14, 2022 10:24:34 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR form 2316 from 2011-2014.

For ITR 2011-2014, please be informed of the below procedure in ITR Filing prior to 2013:
1.	The employers provide for the BIR Form 2316 to their employees after the year ends; and
2.	Subsequently, all employees are required to file their returns to the RDOs where they are registered, with tax due or zero/no payment together with BIR Form 2316 as attachments.

In order for us to properly endorse and work further on your request, we need more information from you regarding your query. Kindly provide us with the following details and email them at ana.marie.du@bir.gov.ph. as this contains sensitive information
-What ITR did you file from 2011-2014? 
-Where did you file your ITR, what RDO are you registered with?
-Your TIN (if self-employed)
-Tax Return Confirmation Receipt (if your ITR were filed online) 

For CY 2014, please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. 

We would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.

The mandatory submission of Employees’ BIR Form 2316 in lieu of the Income Tax Return (ITR), “who are qualified for substituted filing” by the employers started the year 2013, reference-based in RR No. 11-2013 and further amended by RR 2-2015.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Apr 08, 2022 05:25:06 AM, your request will be closed.
