I would like to request for my ITR from Aug 2004 to Oct 2008. Here are time range of each employer:

Employer 1: Aug 2004-June 2005

Employer 2: June 2005-Aug 2007

Employer 3: Aug 2007-Oct 2008

Dear Ms. Menguito,

I refer to my letter of Dec 13, 2021 05:11:58 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR - 2004 to 2008.

In order for us to properly endorse and work on your request, kindly provide us the following details (from 2004-2008)and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information:
- What form did you file? 
-Where did you file your ITR, what RDO are you registered with?
-Your TIN (if self-employed)
-Tax Return Confirmation Receipt (if your ITR were filed online)

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. 

If the documents have been filed to our office, may we suggest that you request these directly to the concerned RDO and bring two valid IDs for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.  

On the other hand, if you are an employee. your employer is responsible to file your BIR Form 2316 and to provide you with BIR Form 2316 ( Certificate of Compensation and Tax Withheld ) not later than January 31 after the close of the calendar year. This certificate of tax withheld BIR Form 2316 which have been filed by your employer and duly stamped received by the BIR is tantamount to the substituted filing of Annual Income Return. 

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 08, 2022 12:46:10 AM, your request will be closed.

Dear Jason Menguito,

We refer to your letter of Dec 13, 2021 05:11:58 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for ITR - 2004 to 2008.

We regret to inform you that upon verification with our BIR-ITS,  you are registered under RDO-44 Taguig City and not within RDO 40-Cubao. Thus, we can not process your request since we do not have any copies of your returns on file. Please see attached print-out of our ITS verification.

However, we may endorse your request to RDO-Taguig City for them to address your concerns and request.

While our aim is to provide information whenever possible, in this instance this Office does not have your record and the information you have requested since your are registered in RDO-44 Taguig City as mentioned in our reply dated March 8, 2022. 
In view thereof, we are denying the herein request.
