November 26, 2021 Dear Agravante, Greetings! Thank you for your request dated Nov 26, 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for 2020 ITR. Response to your request While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested, hence, your request is denied. On the other hand, since you are an employee, your employer is responsible to file your BIR Form 2316 and to provide you with BIR Form 2316 (Certificate of Compensation and Tax Withheld ) not later than January 31 after the close of the calendar year. This certificate of tax withheld BIR Form 2316 which have been filed by your employer and duly stamped received by the BIR is tantamount to the substituted filing of Annual Income Return. Hence, if you have been qualified for substituted filing, your BIR Form 2316 filed can be used for your child's requirement for college and scholarship application. You may directly request this from your employer as they are the main source of such documents. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made. You may also personally request these to the concerned RDO and bring two valid IDs for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC.
