Hello I would like to know the documentary requirements and process map for such documents that may be required by your department for the importation of an aircraft.

Dear John David Silvano,

I refer to my letter of Aug 26, 2021 12:00:12 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Aircraft Importation.

In order for us to work further on your request, we need more information from you regarding your query. May we know if the importer is an accredited importer? also, please be informed that for item tag as regulated this shall be coordinated first with its regulating Agency. You may visit to the tariff commission website https://tariffcommission.gov.ph for the specific HS Code of the commodity and search in PNTR website https://pntr.gov.ph. Contact details of Regulatory Agency is also provided in the PNTR website. 

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 22, 2021 05:38:25 AM, your request will be closed.

Your Request

You asked for Aircraft Importation.

Response to Request

Your FOI request is approved. I enclose a copy of the information you requested.

Please be advised that only BOC-accredited/registered importers can transact business with the BOC for the processing/clearance of their importation/s. Thus, persons (natural or juridical) who intend to engage in importation are required to be accredited/registered with the BOC (as provided under existing rules and regulations).

If the intended importation is only ONCE (in a period of 365 days), the ‘would-be’ importer may apply for registration as a Once-A-Year-Importer. The requirements and procedures are set forth under Customs Memorandum Order 46-2019. If the intended importation is on a regular basis, BOC-accreditation (as a Regular Importer) is necessary. The requirements for accreditation as a “Regular Importer” are provided under Customs Memorandum Order 31-2019, while the procedure for accreditation is provided under Customs Memorandum Order 11-2014 (Section 5a, 5b, 5d, 5e). Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Commissioner Bienvenido Y. Rubio at boc.cares@customs.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
