Dear Mr. Donald Jay Moralejo,

This refers to your request for data on Fiscal Incentives granted to BOI registered firms (2014-2018) under EO 226 and the type of fiscal incentives availed by each firm and the corresponding amount.

Upon review of your request, it was determined that the information requested falls under list of exceptions issued and prepared by the Department of Justice and Office of Solicitor General pursuant to Section 4 of Executive Order No. 2, Series of 2016 (Freedom of Information) which was approved by the Office of the President on 24 November 2016.

One of the exceptions approved is information, documents or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals and boards or officers, in relation to the performance of their functions or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers.

Furthermore, Article 1(2)(a) and (2)(b) of the BOI Freedom of Information Manual states the following information as confidential in nature:
a.	All applications under Executive Order No. 226, also known as the Omnibus Investments Code of 1987, and their supporting documents pursuant to Article 81 hereof
b.	Information classified as confidential, the disclosure of which would prejudice legitimate commercial interests or the competitive position of the investor or its investments.

In view of the foregoing, we regret to inform you that we cannot provide your requested data as the request entails disclosure of confidential information and the information is included in the list of exceptions issued and prepared by the Department of Justice and Office of the Solicitor General pursuant to Executive Order No. 2, Series of 2016. 

Please note that most of the BOI registered enterprises availed of Income Tax Holiday and Duty-Free Importation of Capital Equipment incentives.  You can get a list of BOI-registered enterprises from 2014-2018 per request with our Investment Policy and Planning Service, Planning Division c/o Mr. Zomer Penales at telephone no. 8897-6682 local 311 or send email at zlpenales@boi.gov.ph or you may lodge your request via the FOI portal.
