SInce CWC is the focal inter-agency body of the Philippine Government for children, may I request soft copy of documents related to RA 10821 -
1. Implementing Rules and Regulations of RA 10821;
2. Plans of Council Members to implement the law;
3. Administrative directives or guidelines of CWC or Council members; and
4. Monitoring Mechanism for the implementation of RA 10821
5. Communication plan to disseminate info

I am currently doing a policy research on the status of implementation of the said law since it was enacted in 2016.

Your request

You asked information and soft copy of documents for policy research on the status of implementation of R.A. 10821, as follows:  a)  Implementing Rules and Regulations; b)  Plans of Council Members to implement the law; c)  Administrative directives or guidelines of CWC or Council members; d)  Monitoring Mechanism for the implementation of R.A. 10821; and, e)  Communication plan to disseminate information.

Response to your request

Your FOI request is approved. The answers to your request are the following:

1.	Section 3 of R.A. 10821 or "An Act Mandating the Provision of Emergency Relief and Protection for Children Before, During, and After Disasters and Other Emergency Situations" defined Disaster impacts may include loss of life, injury, disease and other negative effects on human, physical, mental and social well-being, together with damage to property, destruction of assets, loss of services, social and economic disruption, and environmental degradation. Hence, information on how the government viewed and addressed the current pandemic (COVID-19) situation is included.  Information entitled “Quick Data on Children's Situation During the COVID-19 Pandemic” is accessible thru the CWC website with link address at www.cwc.gov.ph.

2.	Soft copy of the following documents are attached, as follows:

2.1	Joint Memorandum Circular (JMC) No. 2020-001, reiterating protocols on reaching out to children, including those in street situations, in need of special protection, children at risk, and children in conflict with the law during the enhanced community quarantine (refer to attached MC).
2.2	 Memorandum Circular No. 2018-196 or guidelines on the localization of the Comprehensive Emergency Program for Children (CEPC) of RA 10821, Children's Emergency Relief and Protection Act.
2.3	RA 10821 IRR.
2.4	CWC Board Resolution on RCPWG Terms of Reference.
2.5	RCPWG Terms of Reference. 
2.6	NCPWG  Terms of Reference. 
2.7	CEPC Localization Guidebook - This is up for revision. Details may be coordinated with the DSWD DRMB. 
2.8	 RA 10821 Localization Guide_NCPWG - The guide contains a menu of suggested activities which can be advocated to respective LGUs for implementation. Based on their available budget/ resources, the LGU may select priority activities on child protection in emergencies related to the establishment of child-friendly spaces, case management for unaccompanied and separated children, training of emergency responders on child protection and information management.
2.9	RA 10821 Annual Report (2016-2019) - The 2020 Implementation Report is currently prepared by DSWD.

3.	As to the monitoring mechanisms of RA 10821, the Council for the Welfare of Children (CWC) chairs the National Child Protection Working Group along with UNICEF and World Vision (NGO Co-Chair) and is supported by the Regional Child Protection Working Groups in 17 regions. 

The N/RCPWG operates based on a Rolling Work Plan that guides the implementation of priority activities on Child Protection. This directly contributes to the targets of RA 10821 provisions. The NCPWG also follows the global trends and priorities, (e.g. Localization of the 2019 Child Protection Minimum Standards, etc.).
