Hi. May we respectfully ask if there's any significant amendments on Department of Budget and Management's Local Budget Circular No. 53, September 1, 1993 regarding the highest level of position below the Assistant Department Head in 5th class municipalities?

This is in clarification of the Circular Letter No. 2007-6: Manual on Position Classification and Compensation if it amends the said LBC.

Dear Ariane Jane Gerelingo,

This refers to your inquiry as regards the highest positions below the Assistant Department Heads  (ADHs) for 5th Class Municipalities.

In accordance with Item 9.2.1.5 of the Manual on Position Classification and Compensation, circularized under DBM Circular Letter No. 2007-6 dated February 19, 2007,  the highest positions below the ADHs for 4th to 6th class municipalities would be positions allocated to Salary Grade 14 to Salary Grade 16.

Will it not violate the provisions in the Local Government Code if we create a SG-16 position in a 5th class municipality?
