Section 31 of Executive Order No. 292, s. 1987 provides that ”Year” shall be understood to be twelve calendar months; “month” of thirty days, unless it refers to a specific calendar month in which case it shall be computed according to the number of days the specific month contains; “day,” to a day of twenty-four hours; and “night,” from sunset to sunrise.

Accordingly, if a person is appointed, assumed office on August 2, being employed for 30 days, should it be counted as full month, qualifying to the 4 month service requirement as of November 30?

Dear Renel Cidro,

Greetings!

This refers to you inquiry on whether an employee who assumed Office on August 2, 2023 is qualified to receive Service Recognition Incentive (SRI) and Productivity Enhancement Incentive (PEI) for FY 2023.

As you have aptly pointed out, Section 31, Chapter 8, Book I of Executive Order No. 292 (Administrative Code of 1987) provides that “year” shall be understood to be twelve calendar months; “month” of thirty days, unless it refers to a specific calendar month in which case it is computed according to the number of days the specific month contains; “days,” to a day of twenty-four hours; and “night” from sunset to sunrise.

Hence, the four (4) months of service referred to under Administrative Order no. 12, s. 2023 and Budget Circular (BC) No. 2023-2 (in the case of the SRI), and BC No. 2017-4 (in the case of the PEI) would correspond to a total of 120 days.

May we further flag that apart from the four (4) months service requirement as of November 30,2023, there are still other conditions for the grant of the SRI and PEI such as satisfactory performance rating, status of appointment, availability of funding source, etc.
