Hi, Are Workers through Institutional COS Contract of Service entitled to

1. Gratuity Pay, per AO 38 (FY 2020), AO 20 (FY 2019)
2. COVID ECQ Hazard Pay, per AO 26 / DBM Budget Circular 2020-1.

That even though the Contractor/Service Provider is the one responsible for the "Payment" to their employed personnel (per COA-DBM JC 1-2017/ updated by JC 2-2020 --- they are still Govt.Workers engaged thru COS, thus, If entitled to such benefits (Admin. Orders 38, 20 & 26),
May the Contractor/Service Provider then bill the NGAGovernmentOffice Unit accordingly for these mandated benefits?

Dear Ms, SORIANO,

This refers to your inquiry as regards the payment of gratuity pay and COVID-19 hazard pay to institutional contract of service workers (COS).

Please note that under Item 6.1.4 of COA-DBM Joint Circular No. 2, s. 2020, "the contractor or service provider shall be responsible for providing the workers with compensation and benefits compliant with existing labor law, including the necessary social security and other benefits mandated by law, in addition to the direct compensation as payment for their services".
