Noted already for Circular JC 2020-2 (already mentioned in the question, re responsibility of Service Provider)

May we please know if Institutional COS Workers are MANDATED by LAW to be paid with, and therefore ENTITLED to : Gratuity Pay and Covid Hazard Pay per the issued Administrative Orders (20,38,26) by the President?

Dear ANA ABIGAIL SORIANO,

This refers to your inquiry on whether Institutional contract of service workers (COS) are entitled to gratuity pay and hazard pay.

May we highlight that under Item 6.2 of COA-DBM Joint Circular No. 2, s. 2020,  workers hired under institutional COS shall  remain to be the employees of the contractor or service provider, albeit their deployment in government offices.

The contractor or service provider, at their own discretion, may grant benefits such as COVID-19 hazard pay to their institutional COS who are deployed in government agencies during the implementation of the ECQ or MECQ.
