I would like to request either the projected or exact amount to be given to LGUs following the Mandanas Ruling. In addition to this, if it is possible to know the increase in % of the LGU budget following the Mandanas Rlling.

Thank you for your request dated Apr 16, 2021 04:39:36 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for request either the projected or exact amount to be given to LGUs following the Mandanas Ruling. In addition to this, if it is possible to know the increase in % of the LGU budget following the Mandanas Ruling.

Response to Request

Based on the submitted certifications of the Bureau of Internal Revenue and the Bureau of Customs on the computation of the share of LGUs from the actual collections of national taxes in FY 2019, the "indicative" increase in the IRA shares of LGUs for FY 2022 due to the implementation of the SC Ruling on the Mandanas-Garcia Petitions amounts to Php 238.6 billion or 28.1% more compared to what the LGUs would get without the implementation of the said SC Ruling.

With regard to the year-on-year "indicative" increase in the share of LGUs from FY 2021 to FY 2022, the LGUs will receive an "indicative" increase amounting to Php 391.3 billion or 56.27% higher than the FY 2021 IRA shares of LGUs. The said "indicative" increase not only represents the implementation of the SC Ruling, but also the "indicative" increase in the actual collections of national taxes in FY 2019. The nominal amount of the increase varies in every LGU, depending on the percentage share of each LGU on the factors that we use in the computation of the IRA, such as the population, land area, and number of LGUs entitled to IRA.
