Good Morning po,

Are we allowed to pay  Hazard Pay, kahit walang PS savings? Then irequest nalang kay DBM yung any PS deficiency before the end of the year? Thank you.

Any Legal Basis po for this?

Dear Anjo Ellis Padilla,

Greetings!

Thank you for your request dated Sep 15, 2021 10:56:30 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You are requesting for clarification on whether an agency may be allowed to grant Hazard Pay  to its personnel despite  the absence of Personnel Services (PS) savings.

May we note that there are several forms of Hazard Pay, such as those received by Public Health Workers,  and  Science & Technology Workers. In this regard, we are assuming that you are referring to the grant of COVID-19 Hazard Pay to those physically reporting for work during the Enhanced Community Quarantine period in their respective work stations. 

For your perusal,  attached are the following issuances relative to the grant of the COVID-19 Hazard Pay:

-	 Administrative Order No. 26, s. 2020, entitled “Authorizing the Grant of COVID-19 Hazard Pay to Government Personnel Who Physically Report for Work During the Period of Implementation of the Enhanced Community Quarantine Relative to the COVID-19 Outbreak”;

-	DBM Budget Circular No. 2020-1, entitled “Guidelines on the Grant of the COVID-19 Hazard Pay”; and

-	Administrative Order No. 43, s. 2021, entitled “Authorizing the Grant of COVID-19 Hazard Pay to Government Personnel Who Physically Report for Work During the Period of Implementation of the Enhanced Community Quarantine and a Modified Enhanced Community Quarantine, Amending Administrative Order No. 26 (s. 2020), and For Other Purposes”.

Sir/ Ma'am I am referring to COVID-19 Hazard Pay, and my question was not answered po. 

Section 3 of AO 26 provides that the 
funds needed for the grant of the COVID-
19 Hazard Pay to employees in the Executive   Branch   shall   be   charged against the following sources:

a.  For NGAs and SUCs the amount 
	required for personnel occupying
regular, contractual   or   casual 
positions   shall    be    charged 
against their available released 
Personnel 	Services 	(PS) 
allotments, while   the   amount 
required for COS or JO workers
shall be charged against their 
available released Maintenance 
and Other Operating Expenses 
(MOOE) allotments, without 
need for prior authority from the 
DBM, provided that all authorized 
mandatory expenses shall have 
been paid first. 

Should an NGA 
or SUC have insufficient PS or 
MOOE allotments, as the case 
may   be, to   fully   cover   the 
COVID-19 Hazard Pay at the 
rate of P500.00 per day per 
person, a lower but uniform 
rate may be granted for all 
 
Further, Item 5.1 of Budget Circular (BC) No.2020-01 provides that:
 
a. The     amount     required     for 
 personnel    occupying    regular, 
contractual or casual positions 
shall be charged against their 
available   released Personnel 
Services (PS) allotments, while 
the amount required for COS or 
JO workers shall be charged 
against their available released 
Maintenance	and	Other
Operating   Expenses (MOOE)

My question is, can we used our available PS to cover the COVID-19 pay of 500 pesos per person and should it result to a deficit in PS allotment, said deficit may be requested to DBM. 

Is this correct?
