I would like to clarify the phrase "a premium of up to 20% of the salary or wage" (Joint Circular No. 1, 2017 COS and JO workers) is it mandatory 20%? or it's up to the employee to impose what percent they want to give to their workers?

Dear Mr. Asilom,

This refers to your request for clarification on the phrase “a premium of up to 20% of the salary or wage” as stipulated under Joint CSC-COA-DBM Circular No. 1, s. 2017.

Specifically, clarification is requested whether the premium is mandatorily set at 20% or at whatever percentage the employer decides on.

We wish to clarify that the premium given to job order (JO)/contract of service (COS) workers should not exceed 20% of their respective salary/wage.    Depending on the availability of funding, a lower premium may, however,  be paid to the JO/COS workers
