Dear Mr. Mejorada,

Thank you for your request dated August 27, 2018 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

However, we regret that your request for the following information cannot be favorably considered:

1.	Copies of Special Allotment Release Order (SARO) pertaining to DAP projects; and
2.	Certification in digital format, to the effect that the project proponent for these SAROs was Senator Franklin Drilon

Hereunder is the reason for our action:

	Information is among the exceptions to the FOI (E.O. No. 2) as protected by the Constitution and pertinent laws, circularized by the Office of the President, and defined by the DBM.

Remarks: 
Please be informed that the requested documents pertain to matters under litigation. 

The DBM FOI People’s Manual provides for the list of exceptions, one of which is document or information pertaining to matters under litigation, the purpose of which is to prejudge a pending issue before a court or obstruct the administration of justice.
