Dear Mr. Howard Joseph Hontanosas, This pertains to your request dated 2 December 2018 for a copy of the digital copy of the Memorandum of Agreement signed on 10 July 1986, by the then Ministry of Defense, Ministry of Tourism, and the Philippine Tourism Authority regarding the lease of Corregidor Island to the DOT-PTA for 50 years. Please be informed that our aim is to provide information whenever possible. However, in this instance, we are unable to provide the information you have requested because the exception under Section 2 of the List of Exceptions to E.O. No. 2 s. 2016 applies to the said Memorandum of Agreement. The said section provides for the exception to the right to access privileged information relating to national security, defense or international relations. In particular, access cannot be granted since the said contract is covered by the “security” provision wherein disclosure is prohibited. If you are not satisfied with this response, you may request for an internal review of such response by writing to the Undersecretary of National Defense who heads the Central Appeals and Review Committee. Your appeal should explain why you are dissatisfied with this response, and should be made within 15 calendar days from receipt thereof. It shall be decided by the Department Secretary upon the recommendation of the Committee within 30 working days from the filing of said written appeal after which you will be notified of the result. In case the same appeal is denied after a review, you have the right to appeal to the Office of the President under Administrative Order No. 22 s. 2011. Thank you.
