Thank you for your request dated 04 October 2017 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
The FOI request
You specifically requested for the contract between Government Arsenal and Samyang Comtech Co. Ltd.
Agency response to FOI request
While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because of the exception under Section 2 of the List of Exceptions to Executive Order No. 2 (s. 2016) applies to the contract. The said section provides for the exception to the right to access to privileged information relating to national security, defense or international relations. In particular access cannot be granted since the said contract is covered by a confidentiality clause wherein disclosure is prohibited. The contract contains military technical design and technology, which the Government Arsenal is prohibited to disclose to any person or entity.
Requestor’s right to appeal
If you are not satisfied with this response, you may request for an internal review of such response by writing to the Undersecretary for National Defense who heads the Central Appeals and Review Committee. Your appeal should explain why you are dissatisfied with this response, and should be made within 15 calendar days from receipt hereof. It shall be decided by the Department Secretary upon the recommendation of the Committee within thirty (30) working days from the filing of said written appeal after which you will be notified of the result. In case the same appeal is denied after a review, you have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
