25 November 2019 Dear Juan, Greetings! Thank you for your request dated 14 November 2019 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for the personnel complement of DND/AFP Response to your request Please be informed that our aim is to provide information whenever possible. However, in this instance, we are unable to provide the information you have requested because of the exception under Section 2 of the List of Exceptions to Executive Order No. 2 s. 2016 applies to the said document. The said section provides for the exception to the right to access to privileged information relating to national security, defense or international relations. In particular, access cannot be granted since the said contract is covered by the “security” provision wherein disclosure is prohibited. Furthermore, we suggest you to resubmit your request through the AFP’s eFOI Portal https://www.foi.gov.ph/requests/new?agency=AFP, as the information regarding the AFP’s personnel complement does not fall under the purview of the DND. Your right to request a review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Undersecretary of National Defense who heads the Central Appeals and Review Committee. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011). Thank you.
