Dear Ma'am/Sir,

Upon searching for the local key players in the bioethanol industry, we found through DOE's website that there are three producers tagged as with "Certificate of Registration with Notice to Proceed".  Link @ https://www.doe.gov.ph/renewable-energy/list-bioethanol

We hope to clarify with you what this means compared to the "List of Accredited Bioethanol Producers", and if these establishments are already in operation.

Thank you for your request dated Jan 03, 2024 11:56:34 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for the Definition of Certificate of Registration with Notice to Proceed; for Bioethanol Producers.

Response to Request

This refers to your data request for clarification on biofuel accreditation in the Philippines for research and development. 

We wish to inform you that under Chapter III, Section 1 of the Joint Administrative Order (JAO) No. 2008-1, series of 2008, an applicant shall secure a Certificate of Registration and Accreditation from the DOE prior to production, distribution, and sale of biofuel. This shall apply to the biofuel producer and biofuel distributor.

We would like to clarify that two (2) types of certificates can be issued to an applicant to manufacture biofuels under Republic Act No. 9367 otherwise known as the Biofuels Act of 2006. 

Sections 2 and 3, Chapter III of the above JAO state that the DOE shall issue a                 (a) Certificate of Registration with Notice to Proceed (CRNTP) which authorizes the applicant to commence construction of the facilities within two (2) years and                      (b) Certificate of Accreditation (COA) prior to commercial operations which is valid for a period of five (5 years).

To date, the REMB classifies the above list of bioethanol producers/projects into facilities with (a) Accreditation for Construction and (b) Accreditation for  Commercial Operations.
