I would like to request the following information for research purposes:

1) Annual volume of each oil players reporting to DOE (Petron, Shell, Caltex, Phoenix, Seaoil, Unioil, Jetti, SL harbor, Total, Microdragon, PTT, High Glory, etc.) with breakdown per product covering periods 2010 to June 2018 if already available.

<The Freedom of Information (FOI) request for data is embodied in a presidential issuance, Executive Order No. 2, s. 2016, stating that:

SECTION 3. Access to Information.  Every Filipino shall have access to information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development.

However, Section 4 of E. O. No. 2 provides that "access to information shall be denied when the information falls under any of the exceptions enshrined in... existing law or jurisprudence."

Such existing law is Section 15(g) of Republic Act No. 8479, which states that the "Secretary shall not have any authority to make public any trade secret or any commercial or financial information which is obtained from any person or entity which is privileged or confidential."  Furthermore, such information may only be disclosed to law enforcement agencies upon certification that it will be maintained in confidence and will only be used for official law enforcement purposes.

Moreover, the requested information is included in the List of Exceptions in the FOI manual of the DOE, to wit:

"OIL INDUSTRY MANAGEMENT BUREAU (OIMB)

1. Any per company data is considered confidential in nature per Section 15(g) of RA 8479 and can only be given to officers and employees of appropriate law enforcement agencies with a caveat that such information will be kept confidential and will only be used only for law enforcement. Please provide the requestor the detailed reason for this exception here.>
