Your Request
You asked for Application for assignment of Clark SPP’s SESC No. 2014-07-086 by EPRRI to CREC; & DOE’s approval.
Response to Request
As much as the DOE would like to provide the above-mentioned request, the DOE regrets to inform you that the copies of the requested documents cannot be granted pursuant to the following provisions of the SESC:
1. Section 11.1, “All documents, information, data and reports produced or generated during the Solar Energy Operations under this RE Contract shall be kept strictly confidential over the term of this RE Contract x x x.”
2. Section 11.6, “The information shall be revealed to those persons allowed under this RE Contract only if and to the extent necessary and desirable for the purpose intended. Each party shall ensure that such person to whom information is disclosed is informed of the confidential nature of the information and the purpose for which it may be used and that each such person is bound by this Section.”
3. Section 11.7, “The RE DEVELOPER and its Affiliates or the DEPARTMENT, its officers, employees, consultants and other duly authorized representatives shall not make any public statement or announcement of any information produced, generated or acquired in the course of the Solar Energy Operations, without prior written consent to the other Party.”
In view of the above, the DOE recommends that Mr. Espiritu submits authorization letters from Enfinity Philippines Renewable Resources, Inc. and Citicore Renewable Energy Corporation for items 1 and 2, respectively.
