On January 28, 2013, the Inquirer reported that the DOE "deferred to the Department of Foreign Affairs the decision to grant permits concerning the exploration and drilling activities at the highly contested Recto Bank [Reed Bank] because the area was part of the disputed waters being claimed by China."

<Please provide the requestor the detailed reason for this exception here. The Office of the President issued EO No.2 to enjoin all heads of offices to operationalize the meaningful exercise of the public of their right to access information on public concerns and to ensure public disclosure and transparency in public service.  The EO allow access to information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as government research data used as basis for public development.

However, the EO admits of certain exceptions, particularly those enshrined in the Constitution, existing law or jurisprudence.  Pursuant to Section 4 thereof, the Office of the President issued Memorandum dated 24 November 2016 circularizing the inventory of exceptions to the right to access of information covered by EO No. 2.  Thereunder, privileged information relating to national security, defense or international relations, which covers diplomatic negotiations and other information required to be kept in the conduct of foreign affairs, are among the listed exceptions.

DOE's decision to defer to the DFA on whether to grant permits for the exploration and drilling activities within the disputed areas should be considered confidential or privileged as it may have a direct effect on national security, defense, or international relations.>
