February 13, 2020 Dear Lyle Christian Herbosa, Greetings! Thank you for your request dated Feb 13, 2020 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Efficacy of Kiti-Kiti X Response to your request While our aim is to provide information whenever possible, in this instance this Office does not have [some of]* the information you have requested. We would deny the requested documents for you already have possession of these files. (see attached response from the DOH Disease Prevention and Control Bureau) Furthermore, we would like to reiterate the response of the Presidential Communications Operations Office to Mr. Herbosa (Annex B), which states that “Exceptions to EO No. 2, s. 2016. Exceptions 1.b. provides that matters covered by deliberative process privilege are exempted from disclosure, namely: i, Advisory opinions, recommendations and deliberations compromising part of a process by which governmental decisions and policies are formulated; intra-agency or inter-agency recommendations or communications during the stage when common assertions are still in the process of being formulated or are in the exploratory stage; or information pertaining to the decision-making of executive officials, and ii. Information, record or document compromising drafts of decisions, orders, rulings, policy decisions, memoranda, etc. The above mentioned documents, being predecisional and deliberative falls under this exception.
