Good day! Follow-up on #DOH-190835822605. While it might be true that there has been no procurement, the government paid for the vaccines, right? 

What are the conditions (price etc.) that the government agreed to pay? Please send me the agreements for each vaccine supplier.

We regret to inform you that we shall not provide the information requested as the request is confidential in nature. 

Executive Order No. 2 s. 2016 dated November 24, 2016 provide exceptions on the Freedom of Information, thus:

"5. Information, documents or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers;"

This was compounded by Memorandum Circular No. 89 (Updating the Inventory of Exceptions to the Right to Access of Information under Executive Order No. 2 s. 2016:

"5. Information, documents or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory or quasi-judicial powers, such as but not limited to the following:

a. Trade Secrets, intellectual property, business, commercial, financial and other proprietary information"

Based on the foregoing, documents known by reason of official capacity are deemed confidential. The contents of the documents requested contains trade secrets intellectual property, business, commercial, financial and other proprietary information that qualifies the information as exempt from the FOI Requirement
