July 4, 2022 Dear Jocelyn David, Greetings! Thank you for your request dated Jun 26, 2022 02:08:24 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Drug Rehabilation Record onfile with my Brother Joel Trinidad Bermas@ Bicutan Rehab Center. Response to your request While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. Please be informed that the requested information is covered by the confidentiality of records under Sections 60 and 64 of Republic Act No. 9165 which reads as follows: Section 60 Confidentiality of Records under the Voluntary Submission Program - Judicial and medical records of drug dependents under the voluntary submission program shall be confidential and shall not be used against him for any purpose, except to determine how many times, by himself/herself or through his/her parent, spouse, guardian, or relative within the fourth degree of consanguinity or affinity, he/she voluntarily submitted himself/herself for confinement, treatment and rehabilitation or have been committed to a Center under this program. xx Section 64 Confidentiality of Records Under the Compulsory Submission Program - The records of a drug dependent who was rehabilitated and discharged from the Center under the compulsory submission program or who was charged for violation of Section 15 of this Act, shall be covered by Section 60 of this Act. We advise you to coordinate the matter with the named patient, and ask the latter to personally request (walk in or written) the desired information from the DOH TRC Bicutan, if any. Should the request be made through a letter, a copy of identification card bearing his signature shall be attached as proof of his identity. Said copy should be signed three (3) times. If the personal request is made through an agent, an authorization letter shall be executed in favor of such agent For your reference and guidance.
