Hi ROD Ilagan/LRA/DOJ team,

I'm writing this request for you to shed us some light regrading the specific steps/ACTIONS that we can take in cases when the purchase Lot Title is burned (not currently in ROD Ilagan Isabela's record).

The only step they told is to wait (no dates given) that is all.

We purchase our relative's land (at their request) but the title is burned and cannot be located in system of ROD Ilagan.

This request may apply to ALL Future LOT title that will/may be burned in the future. So PLEASE take your time and PATIENCE to answer this.

Dear JOHN ADRADOS,

Greetings!

This has reference to the inquiry you sent through the eFOI Portal dated 25 June 2018 requesting for the specific steps/actions in cases when the lot title is burned.

Due to the lack of information stated in your inquiry, we are providing you with the two procedures that you may avail of in this kind of situations, whichever may be appropriate to the circumstances surrounding your case.

The procedures are stated hereinafter:

A.	JUDICIAL RECONSTITUTION OF TITLES 
Applies in case the RD copy is lost or destroyed but administrative reconstitution is necessary as determined by the LRA

1.	Secure certification from Registry of Deeds that the certificate of title on file in the Registry was either lost or destroyed.
2.	Filing of Petition with the Regional Trial Court (RTC) concerned.
3.	Receipt of Petition and Annexes from RTC and forwarding to Reconstitution Division.
4.	Recording of Petitions placing in folder (indexing and assigning Serial Number) and assignment to examiners.
5.	Initial examination of petition
6.	Plotting of Lot in Municipal Index Sheets (MIS) 
7.	Verification of Status of Lot
8.	Determination of the Status of Lot from the Cadastral Decree Section (CDS)
9.	Forward Records of Petition to the Chief of Ordinary and Cadastral Decree Division (OCDD)
10.	Preparation of Technical Report (Lost of both original and duplicate)
11.	Review of initial draft
12.	Final review and affixing of signature 
13.	Review of Technical Report
14.	Transmittal of Petition with the Technical Report to the Clerk of Court.
15.	Issuance of Order of Reconstitution
16.	Preparation or Issuance of Reconstituted Title.


B.	ADMINISTRATTIVE RECONSTITUTION OF TITLES
Applies in case of substantial loss or destruction of titles in the RD due to fire, flood or other force majeure to be determined by the Administrator of the LRA, provided that the number of certificates of titles lost or damaged is at least 10% of the total in possession of the RD and provided further that the lost or destroyed certificate of titles are at least 500 pieces.

1.	Registries of Deed (RDs) receive applications/affidavits and other related documents for reconstitution of titles
2.	RD sends application/affidavit to the Central Records Section (CRS) in the Central Office (except for RD in Quezon City)
3.	CRS receives applications from the RODs and forwards to the Reconstitution Division
4.	Receiving Clerk assigns Folder Number and Index Application
5.	Examiner 1 conducts assessment of application (petition and attached documents)
6.	Cartographers plot the technical description of the Petitioned Lot in the Municipal Index Sheets (MIS)
7.	Examiner 2 conducts initial examination of the titles and its accompanying documents
8.	Examiner 3 conducts final examination of the titles and its accompanying documents
9.	Reconstituting Officer (Head of the Reconstitution Division) examines the application (petition and its attached documents) and affixes his initials in the petition
10.	Clerk 1 types the Order for Reconstitution
11.	Clerk 2 proofreads initial copy of Order for Reconstitution
12.	Reconstituting Officer affixes his signature in the Order for Reconstitution of the Title
13.	The Director of the Legal Affairs Department is informed of the newly issued Order for Reconstitution
14.	The Reconstitution Division sends copies of the Order for Reconstitution to the concerned RDs
15.	Applicants obtain copy of Order from Reconstitution Division to bring to the ROD
16.	The Reconstitution Division prepares and transmits Judicial Forms (to be used for Reconstituted Titles) to the concerned RDs upon the finality of the Order 
17.	The RD issues the Reconstituted Titles.
