Communications

Requested from DOJ by K. Mountney at 09:52 PM on May 18, 2021.
Purpose: Legal
Date of Coverage: 05/18/2017 - 05/18/2021
Tracking no: #DOJ-564577830213

Mountney 09:52 PM, May 18, 2021

I would like a copy of all communications between the DOJ and the AGD of Australia in relation to a potential Extradition Request of MARIA KATHRINA KATHLEEN MALIGRO MOUNTNEY, where I am the person who has made the Extradition Request and victim of Attempted Parricide. I note under law there is no exemptions on these communications as they are outside of the law of extradition and the Treaty an unofficial communications, and not diplomatic communications. They are also not law enforcement communications as ruled by the Supreme Court, and not exempt under FOI laws of the Philippines.

Executive Order No. 2, s. 2016

SECTION 9.
(d) The government office shall respond to a request fully compliant with requirements of sub-section (a) hereof as soon as practicable but not exceeding fifteen (15) working days from the receipt thereof. The response mentioned above refers to the decision of the agency or office concerned to grant or deny access to the information requested.

SECTION 6.
In making such determination, the Head of the Office or his designated officer shall exercise reasonable diligence to ensure that no exception shall be used or availed of to deny any request for information or access to public records, or official records if the denial is intended primarily and purposely to cover up a crime, wrongdoing, graft or corruption.

Dear Kisha Mountney,

Thank you for your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Extradition Requests.

Unfortunately, the official communications between Philippines and Australia are confidential regarding extradition. This would constitute a prejudicial disclosure of information which could hamper international relations between the two nations.

Thank you

Respectfully,
EMMELINE AGLIPAY VILLAR
Undersecretary
FOI Decision Maker
