Your request
You asked this Department to clarify the legal basis of the operation by your municipality of Off-site Cockpit stations.
Response to your request
While your request is not among the information covered under Section 1(a) of E.O No. 2 (s.2016), this Office has taken the liberty to answer your query.
Section 447 (3) (v) of Republic Act No. 7160, otherwise known as the Local Government Code, provides that the Sangguniang Bayan, as the legislative body of the municipality, shall have the power, among others, to enact ordinances authorizing the issuance of permits or licenses for the establishment, operation and maintenance of cockpits, and regulate cockfighting and commercial breeding of gamecocks.
You may therefore wish to review ordinances issued by your local Sanggunian to ascertain if there exists legal basis for the operation of cockpits in your locality.
Your right to request a review
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Hon. Menardo I. Guevarra, Secretary of Justice. Your review request should explain why you are dissatisfied with this response, and should be made within fifteen (15) calendar days from the date when you received this letter.
