Dear DOJ-Office of Cybercrime, I would like to request pertinent statistical data re: cybercrime offenses (complaints + resolved cases) involving* personal data, such as cybercrime offenses (allegedly or proven) committed: 
1)  as a result of and/or resulted in an unauthorized access to personal data** 
2)  as a result of and/or resulted in an unauthorized disclosure of personal data** 
3) as a result of and/or resulted in an unauthorized alteration of personal data** 


*involvement = as a result of, and/or resulted in
**as defined by the Data Privacy Act of 2012

You asked for data on the number of cybercrime cases filed and resolved.

Response to your request

The information you requested is already available online. Your request cannot therefore be counted as a valid FOI request. In any event, you may retrieve your requested information from this url:

Attached herewith, for your reference, is the table providing the DOJ Prosecution Statistics.

On the other hand, the other information requested is unavailable at our Office and the procurement thereof will require action beyond our mandate. 

Please be informed that pursuant to Section 4 of Executive Order No. 2 (s.2016), case records are deemed confidential as it contains sensitive personal information. For this reason, perusal of case records for purposes other than prosecution is not permitted.  

Moreover, although citizens are afforded the right to information and, pursuant thereto, are entitled to "access to official records," the Constitution does not accord them a right to compel custodians of official records to prepare lists, abstracts, summaries and the like in their desire to acquire information on matters of public concern. (Valmonte v. Belmonte, G.R. No. 74930 February 13, 1989)

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Hon. Menardo I. Guevarra, Secretary of the DOJ. Your review request should explain why you are dissatisfied with this response, and should be made within fifteen (15) calendar days from the date when you received this letter.
