This is to acknowledge receipt of the inquiry you sent through the eFOI portal, dated 12 February 2018, requesting for the nationwide number of rape cases, by region, which have been exonerated, dismissed, and penalty not imposed by reason of the parties subsequently married each other, as well as the total number of rape cases filed. With regard to your request for national and regional information on rape cases filed and dismissed, please see the attached Memorandum, dated 01 March 2018, from the OIC-Chief of Planning and Statistics Division of the Department of Justice. However, anent your request for information relative to the dismissal due to the subsequent marriage between the parties, this Department is constrained to deny such request considering that the non-imposition of penalties due to the subsequent marriage of the parties falls within the purview of the courts and the said information requested is not under the custody of this Department pursuant to the Inventory of Exceptions to Executive Order no. 2, which provides that lists, abstracts, summaries of information requested are exempt from the right to access to information when such lists, abstracts or summaries are not part of the duties of the government office requested.
