SUBJECT:	RESPONSE TO THE FOI QUERY TO THE DEPARTMENT OF JUSTICE OF MR. PETER LOUIE BESONAYA

Greetings!

This is in response to your eFOI query dated 20 January 2017 requesting for an update about the investigation on the proliferation of drugs in the New Bilibid Prison involving Sen. Leila De Lima.

Based on our records, there are three complaints filed before the Department of Justice against Sen. Leila De Lima, to wit:

1.	Violation of Section 5, in relation to Section 26 (B) of R.A. 9165, with NPS Docket No. XVI-INV-16J-00313 filed on October 11, 2016;

2.	Violation of Section 5, in relation to Section 26 (B) of R.A. 9165 with NPS Docket No. XVI-INV-16J-00315 filed on October 13, 2016; and,

3.	Violation of Section 5 and Section 26 (B) of R.A. 9165, Section 27, of R.A. 9165, with NPS Docket No. XVI-INV-16K-00336 filed on November 10, 2016.

These cases are still being heard and are pending investigation before the respective assigned prosecutors. 

We acknowledge your right to access to public information, as recognized by the Constitution, existing laws and jurisprudence. However, this right admits of exceptions such as the prejudicial premature disclosure and matters considered confidential like records of proceedings or information from proceedings which, pursuant to law or relevant rules and regulations are treated as confidential. 

Since the three complaints filed against Sen. Leila De Lima are still pending investigation, we cannot disclose the contents of the proceeding without violating the rule on confidentiality.
