12 March 2019 Dear JM Laude, Greetings! Thank you for your request dated 06 March 2019 6:26 PM, under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for a list of complaints filed in violations of Republic Act No. 10911 otherwise known as the Anti-Age Discrimination in Employment Act. Response to your request While our aim is to provide information whenever possible, in this instance this Office cannot provide the information you have requested. The requested list of cases refers to information covered by the inventory of exceptions pursuant to Section 4 of Executive Order No. 2 (s.2016), clarified by the Memorandum from the Executive Secretary dated 24 November 2018. Paragraph 4 of the above-described Memorandum specifically exempts confidential information for the protection of the privacy of persons and certain individuals, such as minors, victims of crimes, or the accused. The requested list contains sensitive personal information. As defined under the Data Privacy Act of 2012, sensitive personal information refers to personal information: 1. about an individual’s race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations; 2. about an individual’s health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings; 3. issued by the government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and 4. specifically established by an executive order or an act of Congress to be kept classified. Your right to request a review If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Hon. Menardo I. Guevarra, Secretary of the DOJ. Your review request should explain why you are dissatisfied with this response, and should be made within fifteen (15) calendar days from the date when you received this letter. We will complete the review and tell you the result thereof within thirty (30) calendar days from the date when we receive your review request. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011). Thank you.
