Good day. We would like to request a copy of a case file for criminal case 2021-016. The offender have a warrant of arrest for RIR to serious physical injuries with damage to property signed and issued October 21, 2016.

We would like to know if the warrant is still active or have been recalled. We have tried to coordinate with our local PNP but sadly the case file have been destroyed due to a flood. The person to be served the warrant is currently residing in our subdivision and we fear that anytime he would do an act of crime that would endanger us.

Response to your request

While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested because the DOJ does not have jurisdiction over arrest warrants. Please be informed that the DOJ is under the Executive branch government which mainly handles the prosecution of criminal cases. On the other hand, courts which have jurisdiction over arrest warrants, is under the Judicial branch of government. It may be best if you coordinate with the Supreme Court (SC) at pio@sc.judiciary.gov.ph. Unfortunately, we cannot forward your request to the SC since they are not on-board the FOI platform.
