ILAGAN 10:27 PM, Sep 14, 2022

Dear FOI:

I am a Registered Master Plumber by profession.
I would like to request for the status of the case under CA GR CV No. 93418 in which the Court of Appeals has issued its order on the validity of Section 301 (2a) Section 302 (3g), 302 (9), and 303 (8) of the 2004 RIRR of the National Building Code. I would like to inquire whether there is a pending appeal to the Supreme Court at present regarding CA GR CV No. 93418, or the decision of the CA has become final and executory.

Thank you.

Respectfully yours,
LORLYN ILAGAN

Dear LORLYN ILAGAN,

Greetings!

Thank you for your request dated Sep 14, 2022 10:27:27 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for CA GR CV No. 93418.

Response to your request

While our aim is to provide information whenever possible, in this instance this Office does not have [some of]* the information you have requested since the Supreme Court (SC) is not under the jurisdiction of the DOJ. The SC is under the Judicial branch of government while the DOJ is under the Executive branch of government. Unfortunately, the SC is not on-board the FOI platform since the FOI program is merely implemented by virtue of an Executive Order from the President which only covers agencies under the Executive branch.

To assist you, you can try e-mailing the SC at pio@sc.judiciary.gov.ph.

Thank you,

FOI Receiving Officer
