Resending to you our reply  to your request for information dated 07 December 2016 for monitoring purposes. Note that this request for information was already acted upon within the 15 day working period.

Dear Mr. Reyes:

The undersigned is writing in response to your letter, sent by e-mail, dated 07 December 2016 relative to DOJ Opinion 1, s. 1996.

A review of the said Opinion reveals that the same was in response to a referral to this Department by the Secretary of the Department of Transportation and Communication of the issue raised by the Philippine Monorail Transit System, Inc. (PTMSI) as to whether or not the franchise granted to the PTMSI can still be activated without violating existing laws.

Anent the question of the purpose of the Opinion, it appears that the said Opinion was requested by the Secretary of DOTC to address the issue raised by PTMSI.

Please be advised, however, that then Secretary of Justice, Teofisto T. Guingona, Jr., in his Opinion, refrained from rendering the desired opinion since the issue involved questions which are justiciable in nature or which may be the subject of a judicial controversy.
