Greetings!

Thank you for your request dated Feb 12, 2019 08:18:47 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You requested a copy of the letter dated 19 September 2018 issued by this Department to the Land Registration Authority regarding the Nayong-Pilipino-Landing Resorts Philippines Development Contract. 

Response to Request

While our aim is to provide information whenever possible, in this instance this Office cannot provide the information you have requested. The requested letter refers to information covered by the inventory of exceptions pursuant to Section 4 of Executive Order No. 2 (s.2016), clarified by the Memorandum from the Executive Secretary dated 24 November 2018. 

Paragraph 1 of the above-described Memorandum specifically exempts matters covered by deliberative process privilege, such as advisory opinions, recommendations and deliberations comprising part of a process by which governmental decisions and policies are formulated; intra-agency or inter-agency recommendations or communications during the stage when common assertions are still in the process of being formulated or are in the exploratory stage; or information pertaining to the decision making of executive officials, among others. 

It is the established policy of the Department to decline to grant requests for copies of opinions, which as in this case, are not for general circulation. The only exception is when the interested requesting party is able to secure written permission from the agency for which the subject opinion was rendered, i.e the Land Registration Authority in this case. 

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Hon. Menardo I. Guevarra, Secretary of the DOJ. Your review request should explain why you are dissatisfied with this response, and should be made within fifteen (15) calendar days from the date when you received this letter. We will complete the review and tell you the result thereof within thirty (30) calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
