Hi, in relation to my previous request, the provision cited in the ERC FOI Manual for denying my request on other attachments is very unclear. Please cite specific wording in the Manual.

I humbly re-iterate my request for other attachments of EERI's and Masinloc's Application not covered by the motion for confidential treatment of information, i.e., Annexes A, B, C, D, E, F to T,  V, Z, AA to CCC, to be able to have a comprehensive review of my family's future electricity rates affected by these new contracts.

Dear Mr. Rodriguez,


This has reference to your request for information dated 08 April 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch with Tracking No. #ERC-381197622105.

You requested for:

a)	PSA of EERI and Masinloc

A perusal of the records of these cases show that you have not filed any Petition for Intervention which would allow you to be admitted as party to these cases and be entitled to be furnished with copies of the said annexes. 

Pursuant to Rule 8, Section 4 of the Commission’s Revised Rules of Practice and Procedure (RRPP), each party of record to a case is entitled to be furnished with copies of all pleadings and documents, except those covered by  motion for confidential treatment of information. However, you have not yet established your standing as intervenor to these cases through the filing of the corresponding petitions for intervention.

In view thereof, the Legal Service cannot grant your request for the copies of the annexes of the MERALCO-MPPCL and MERALCO-EERI Applications.  Nonetheless, you may visit the ERC official website at www.erc.gov.ph, and access copies of the Joint Application, wherein the salient features of the Power Supply Agreements (PSAs) of the above-mentioned cases are also included.  In the alternative, you may request from MERALCO for copies of these PSAs and other annexes you need.

Likewise, you may be apprised of your concern regarding your future electricity rates with MERALCO by attending the scheduled virtual hearings of these cases, by providing the ERC, thru legal.virtualhearings@erc.ph, with your e-mail address/es and indicating therein the case number of the Joint Application, wherein you intend to join. For this purpose, you may visit the ERC official website to access the respective Notice of Virtual Hearing of these cases.
