Good Day

I would like ask on who was the owner of the parcel of land (Lot 2867-0-3 of the subdivision plan Psd-04-120680 being portion of Lot 2867_c, Psd 26801, D.R.O Rec. No. situated in Barangay of Mayago Municipality of Baco Province of Oriental Mindoro? Because it was donated by the Philippine Institute of Civil Engineer in the said Barangay that was affected by 1994 earthquake and tsunami. And as of today someone is claiming that this said lot was owned by them.

Thank you for your request dated Nov 13, 2020 11:04:42 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for Transfer Certificate Title.

Response to Request

As to your titles with (1) certificate of title no. is 321, and (2) certificate of title no. RT-192 (T_1576), please request them from the Registry of Deeds of the City or Province where your property/ies is/are located. You cannot immediately know the registered owners on the face of said titles.

As to Lot 2867-0-3 of the subdivision plan Psd-04-120680 being portion of Lot 2867_c, Psd 26801, D.R.O Rec. No. situated in Barangay of Mayago Municipality of Baco Province of Oriental Mindoro, please request a certified true copy of the subdivision plan Psd-04-120680 and/or Psd-26801, from the Bureau of Lands or DENR from that region.

As to other claimant, this is litigious in nature where the other claimant must prove to the court that he/she is indeed the owner of the aforesaid lot. The RTC "may" ask the other claiman for a relocation survey to show that his claim over the aforesaid lot is ligitimate.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
