Hello! I am a 4th year law student from University of Batangas. I would like to ask for some information that I need for my research about plea bargaining on drug cases.

Particularly, I would like to request for the following:
1. Number of drug cases filed 
2. Number of drug cases disposed through plea bargaining (Are these consented or objected by the Prosecution?)
3. Number of drug cases disposed through other means (Acquittal, Conviction, Dismissal, etc.)
4. Number of pending drug cases

Other information such as statistics and case reports will also be of good help.

Thank you for your request dated December 17, 2019 11:47 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for information on Plea Bargaining on Drug Cases

Response to Request

Your FOI request is approved. From December 1, 2018 to November 30, 2019, this Office received a total of 125,521 new drug cases.  For the same period, a total of 153,196 drug cases handled by this Office were terminated; ending in conviction, acquittal or other dispositions.  As of November 30, 2019, this Office is handling 124,012 drug cases in various courts across the country.

As to your query on the number of cases disposed thru plea bargaining,  while our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested. However, you may wish to contact the National Prosecution Service of the Department of Justice at (+632) 8523 8481 to 98, or the Office of the Court Administrator of the Supreme Court at (+632) 5236479, who may be able to help you.  

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to the Honorable Chief Public Attorney Dr. Persida V. Rueda-Acosta, DSD at 5th Floor, DOJ Agencies Building, NIA Road corner East Avenue, Diliman, Quezon City. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
