Greetings!

Thank you for your request dated July 13, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch for "Philippine Commission on Women TERM".

Your Request

You asked, "is there a Republic act, Circular, or Bills saying the years of terms of Chairperson , Executive Director (sic)?"

Response to Request

Your FOI request is approved. Provided below is the response, as discussed with PCW's legal officer:

There is no law, circular or issuance stating the years or term of office of the PCW Chairperson. For your reference, please find attached Presidential Decree No. 633, s. 1975 which served as the original charter of the PCW and its latest amendment - Executive Order No. 167, s. 2022. In the absence of a term of office, the position of the Chairperson is subject to the discretion of the President as the appointing authority and is coterminous to the latter's term. Being a presidential appointee without a specific term, the Chairperson does not have the privilege of security of tenure.

As for the Executive Director, the position is classified as part of the Career Executive Service which is a permanent position. The occupant of the office of the Executive Director is entitled to security of tenure if she has CES Eligibility. If she has none, her term is also coterminous with the appointing authority.

Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
