Dear Sir/Madam,

We'd like to ask, IN GENERAL, all released Guidelines and Policies, old and new, regarding the Sale of NAFCO Lands and Controlled Plantations, in Davao City, throughout the time period indicated in the request.

Up to this date, June 2022, still no new Guidelines and Policies, according to PMO.

The crafting of the new Guidelines and Policies might have been too long. It's been more than a decade now.

Your Request

You asked for All the Guidelines and Policies on the Sale of NAFCO Lands and Controlled Plantations, Davao city.

Please note that National Abaca and Other Fibers Corporation's (NAFCO) assets were transferred to the Board of Liquidators (BOL) for liquidation when the NAFCO was abolished in 1950 . When the defunct BOL was merged with PMO in 2005 , all the assets BOL was mandated to dispose was transferred to the National Government which entrusted said assets and/or rights to the PMO for disposition. 

Under EO No. 323 , any and all sales or dispositions are approved by the cabinet-level Privatization Council (PrC), which are generally based on current Fair Market Value (FMV) and in accordance with existing guidelines such as those of the Commission on Audit (COA).   Otherwise stated, lands assigned to the PMO for disposition needs to be paid for, approved, and conveyed pursuant to general guidelines on the disposition of government assets, in particular, as approved by the Privatization Council.
 
In the event that guidelines or regulations for the disposition of the transferred BOL assets will be approved by the PrC, the PMO shall duly publish the same, and inform relevant parties on record.  In line with this, the deliberations on the proper course of action for each specific account/lot are being undertaken for endorsement and recommendation to the Privatization Council for the authority for execution of the appropriate disposition/sale.
