PRESIDENTIAL DECREE No. 1829

Section 1. The penalty of prision correccional in its maximum period, or a fine ranging from 1,000 to 6,000 pesos, or both, shall be imposed upon any person who knowingly or willfully obstructs, impedes, frustrates or delays the apprehension of suspects and the investigation and prosecution of criminal cases by committing any of the following acts:

(b) altering, destroying, suppressing or concealing any paper, record, document, or object, with intent to impair its verity, authenticity, legibility, availability, or admissibility as evidence in any investigation of or official proceedings in, criminal cases, or to be used in the investigation of, or official proceedings in, criminal cases;

(c) harboring or concealing, or facilitating the escape of, any person he knows, or has reasonable ground to believe or suspect, has committed any offense under existing penal laws in order to prevent his arrest prosecution and conviction;

Section 12. Privacy and Confidentiality of Proceedings. - All hearings and conciliation of the child and family cases shall be treated in a manner consistent with the promotion of the child's and the family's dignity and worth, and shall respect their privacy at all stages of the proceedings. Records of the cases shall be dealt with utmost confidentiality and the identity of parties shall not be divulged unless necessary and with authority of the judge.

Greetings!

Thank you for your request dated Jan 20, 2023 05:44:26 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for Name of Officer PRO9 providing RA7610 Resolution and causing publication of.

Response to Request

Please be informed that this PRO acted immediately on all valid requests of Ms. KMM. It appears that the alleged uploading of confidential resolutions was not intended to be public. The FOI team is of the opinion that requests can only be gleaned by the requester and the sender. However, the portal which requires the user to request a certain type of document opens it up to anyone across the globe. This could affect the desired process. Aforesaid resolution issued by the Olongapo City prosecutor Office has been approved for posting by the undersigned as a reference for denial of the request made by Ms. Mountney with subject “What are the improper motives PCOL GIOVANNI CALIAO of PRO9 has accused me of in Public on this Site” dated November 17, 2022. It was not the team’s intention to put the requester in a bad light or violate her rights. 

PRO9 adheres to the Constitutional mandate of upholding the right to Freedom of Information subject to certain requirements and restrictions imposed by the law. Thus, it can be gleaned on the uploaded attachment that the name of the herein requester was never mentioned. It is our oath to protect the rights of the citizenry most specially the child’s right.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to PRO9 FOI Section, Camp. Abendan, Mercedes, Zamboanga City. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter.
