Hello, I am wangzhikai, a Chinese citizen, and I would like to ask if there are any questions about police reports.

In February 2022 I was going to take a flight back to my country and was unloaded by the immigration officer at the airport and they showed a police report of a theft complaint against me in 2020 at the kawit police station.

I contacted the kawit police department on behalf of someone else to seek clarification on this false police report and to request that a certificate be issued thereafter to prove that the complaint had been resolved.

The kawit police department responded

The response from the kawit police department was that my name did not exist in their files and I did not need an explanation for this complaint. I applied to them to issue a certificate that the complaint had been resolved in order to resolve my issue with the immigration office. But the kawit police department refused on the grounds that the former police chief who issued the police report was no longer in office.

The INS sued me on the basis of this police report, and then this complaint was dismissed by the INS prosecutor for lack of evidence.

The INS officer then slapped me with an ethics violation, directed me to reduce my visa, pay an unreasonable fine and leave the Philippines, and had my name blacklisted.

I don't think this is fair and I want to know how I can get a no file record to prove that the police department has no file on me and without a no file certificate I can't get justice with the INS!

While our aim is to provide information whenever possible, in this instance, as per recommendation of the Regional Legal Office 4A, the requester is advised to apply for NATIONAL POLICE CLEARANCE to confirm the status of his theft complaint. Further, in case Kawit MPS doesn't yet implemented the National Police Clearance System (NPCS), certification or Local Police Clearance may be issued based on their available records with regards to the subject complaint.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Regional Director, PRO 4A.
