May I ask po bakit sa NSO ko po ang surname ko ay sa papa ko pero sa PSA sa Mama ko po na Surname ang naka lagay? May annotation na rin ang live birth certificate ko po. Ano po ba ang dapat gawin? Bakit magkaiba po ang surname ko sa NSO at PSA kung pareha lang po ang agency na ito at ang logo lang ang nag iba?

Greetings!

Thank you for your request dated May 21, 2022 04:08:17 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for Birth certificate.

Your FOI request is approved. 

In reference to your inquiry, if you have two registered birth records, as per policy of the PSA and under Philippine laws, the first incident of registration of an event, i.e., birth, marriage, or death, is the one considered as true and legal. Hence, the copy of the civil registry record which was registered FIRST will prevail. An entry, or entries, on a birth record cannot be corrected through the filing of the late registration of the same.

Kindly be advised that in case of multiple registrations of birth, the first or timely registration shall prevail. Hence, it invalidates all succeeding registration unless a court decision is issued stating that the first registration is canceled.

You may file a petition in court for the cancellation of the first/timely registration of birth to be able to use the second/delayed registration.
