Hi, I would like to obtain:
1.) A copy of any agreement, MOI, work order, contract, or any other communication documents between the SEC and Home Credit in relation to this video posted on the SEC's website: https://www.sec.gov.ph/lending-companies-and-financing-companies-2/complaints/
2.) An explanation as to what policy allows the SEC to advertise for Home Credit by posting a link to their youtube page, but not provide similar links to other lenders.
3.) The legal justification (RA, Administrative Order, Etc) requiring complainants to talk to the lending company before filing a complaint.

You asked for Documentation Concerning SEC's Complaint Guide Video And Complaint Policies.
Response to Request
Please be clarified that the subject video was a collaborative effort between the Commission and the Philippine Finance Association (PFA).
In light of the recent proliferation of online lending platforms, as well as the unethical dealing and collection processes used by a number of financing and lending companies, the Commission seeks to spread awareness through the use of the said video or infomercial tackling topics such as the basic rights of the borrowers, common violations committed by financing and lending companies against these borrowers, and different remedies provided by the SEC.
The said video is posted on the Commission’s website and purposely made available to the public. Thus, it can be used for the information of all lenders and borrowers.
As to the legal justification for requiring borrowers to reach out to the company concerned, we would like to invite you for a conference via Zoom to explain this requirement further. Please inform us immediately of your availability so we can send you the Zoom link and make further arrangements. You may send your confirmation to cgfd_md@sec.gov.ph.
Your right to request a review
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Commission Secretary at comsec@sec.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.
If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
