The lending company Surity Cash has been sending unfair and harassing messages. I have spoken with one of their agent over a recorded line (with advise to agent) notifying that my payment will be delayed for 2 days due to unforseen financial circumstances. After that, I keep receiving sms threatening to contact all my contacts and posting all my details if payment was not made today. My due date is only today but I've been receiving harassing sms since yesterday. I'll be sending the call recording along with the list of phone numbers and screenshot of sms received

Hello Sir/Ma'am,
Just wanted to add, that I've been suddenly receiving sms and calls from other unknown lending companies like eperash, honey loan, nxcomm, peranyo at more encouraging me to loan from them. I've never been in contact with these companies and neither did I willingly provided my contact information. I am thinking of a possibility that my contact number and information has been disclosed illegally to these companies.

You asked for Filing a Formal Complaint for Debt Collection harassment and threat of Privacy against Surity Cash.
Response to Request
Upon reading your complaint, it may indicate possible violation of the SEC Memorandum Circular No. 18, series of 2019, or the Prohibition on Unfair Collection Practices. In this regard, you may file a formal complaint with us by following the instructions below:
1. To File a Formal Complaint Against a Lending or Financing Company
Download and fill out the Complaint Form completely and accurately: https://www.sec.gov.ph/wp-content/uploads/2021/04/2021FORM_Updated-Complaint-Form.docx
2. Provide the necessary attachments, namely:
a. relevant documents and evidence that will support your claim/s or allegation/s ( e.g. screenshots of text messages and conversations with the financing/lending company);
b. loan agreement (if any);
c. valid government-issued ID; and
d. evidence/proof that you have exhausted all remedies against the company concerned before filing your complaint with the SEC, if any.
3. Indicate the following personal information of the complainant in the complaint form:
a. personal e-mail address;
b. personal contact number/s; and
c. address (in the Philippines) where you may be furnished a copy of letter/s and order from the Commission.
4. Use the below format in the subject head of e-mail in sending the complaint form to cgfd_md@sec.gov.ph: COMPLETE NAME_RESPONDENT COMPANY _SUBJECT OF COMPLAINT
