Hello, I would like to obtain clarification on what actions (if any) the SEC has taken, is taking, or plans to take against registered lending or finance companies (LC/FCs) that are not in compliance with AML/CFT rules.

For particulars, a number of LC/FCs have conceded to the SEC, in GIS filings that they are not in compliance. These companies include Prosperity & Success Lending Investor Corporation, Multi-Rich Lending Corporation, and many others.

Has the SEC taken any action to enforce the law or hold lawbreakers liable for non-compliance?

This refers to your request filed under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch on 15 February 2021 regarding the Commission’s official actions against the companies you have mentioned in the said request.

For your information, the SEC is currently conducting fact-finding investigation on these  companies. In relation to this,  we invite your attention to Sec. 2-4, Part II, Rule II of the 2016 Rules of Procedure of the Securities and Exchange Commission which provides that any information, document or records obtained by the Commission in the course of any investigation or examination shall be confidential in nature. As such, details as to the investigation and proceedings appurtenant thereto are exempted from the coverage of the FOI program.
