13 March 2020 Dear Ms. Eriks Kristel Romero: This refers to your request dated 11 March 2020 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request: “I am a third year student of Juris Doctor Program in De La Salle Lipa College of Law. As part of our requirement in our course, I am currently conducting a research entitled: ‘Probing into the Legal Implication on the Right to Due Process of the Parties in Judicial Declaration of Presumptive Death of Absent Spouse for purposes of Subsequent Marriage and his Timeless Reappearance under the Family Code’ I am requesting for the said document most specifically on the deliberations in amending Article 83 of the Civil Code to Articles 41-44 now, of the Family Code. Kind regards.” Purpose/(s) stated for request: “This is intended for my research in fulfillment of my Juris Doctor Degree.” Response to your request We are constrained to DENY your request as the same requires us in effect to perform research services for you and therefore your request falls outside the ambit or purview of the abovementioned E.O. and the Constitutional provision that it seeks to implement.
